1. Definitions

1.1. These extensive terms and conditions use the following definitions:

Flitsmoment: The group of independent entrepreneurs operating under the name Flitsmoment, specialised in photobooth rental.

Flitsmoment, Flitsmoment Utrecht: The sole proprietorship Flitsmoment, located at Brinkwal 9e, 3432GA Nieuwegein, registered with the Dutch Chamber of Commerce under number 71044523, represented by Jesse Uilenreef, reachable by email at info@flitsmoment.nl, utrecht@flitsmoment.nl and by phone at 0652243146. Flitsmoment is also the owner of the Flitsmoment brand name. Flitsmoment Utrecht is the franchisor.

Flitsmoment Den Haag: The sole proprietorship Flitsmoment Den Haag, located at Duinslag 30, 2554BS Den Haag, registered with the Dutch Chamber of Commerce under number 86336304, reachable by email at denhaag@flitsmoment.nl and by phone at 0614978449.

Service provider: The specific Flitsmoment location with which the customer enters into an agreement, as stated in the quote and confirmation email. Where these terms and conditions refer to "Flitsmoment" in relation to rights and obligations, the relevant service provider is meant.

Customer: A natural or legal person entering into an agreement with a Flitsmoment location for the rental of a photobooth.

Agreement: The arrangements recorded in writing or online between the service provider and the customer regarding the rental of a photobooth.

2. Photobooth Rental

2.1. Flitsmoment offers various packages and options for photobooth rental, including backdrops, props, and other personalisation options. The specific features of each package are clearly communicated via the website, written agreement, or other means of communication.

3. Reservation and Payment

3.1. Upon confirmation of a quote, the booking is processed in our system and the customer receives an email confirmation with a link to a personal page. This confirmation clearly states which Flitsmoment location (Utrecht or The Hague) the agreement was made with. This is the official confirmation of a booking.

3.2. Full payment of the agreed rental price must be received no later than two weeks before the event.

3.3. The following conditions apply in case of cancellation:

Cancellation up to 6 weeks before the event: no charge
Cancellation between 6 and 4 weeks before the event: 50% of the rental price due
Cancellation between 4 and 2 weeks before the event: 75% of the rental price due
Cancellation within 2 weeks of the event: 100% of the rental price due

3.4. If the photo strip design has already been created at the time of a cancellation made less than 6 weeks before the event, an additional €35 excl. VAT will be charged on top of the cancellation percentage.

3.5. Rescheduling the date is possible up to 1 week before the event, subject to availability on the desired new date.

4. Use of the Photobooth

4.1. The photobooth must be used indoors and may be used during the agreed period according to the selected package. Extra hours are available at the applicable rates.

4.2. A stable power supply and internet connection are required for the photobooth to function correctly. Flitsmoment reserves the right to provide remote technical support.

5. Liability

5.1. The customer accepts full liability for damage caused by the customer while using the photobooth.

5.2. Use of the photobooth is at the customer's own risk. The customer is fully liable for injury, property damage and other consequences resulting from the use of the photobooth.

6. Photos and Data

6.1. After the event, the photos taken are sent to the customer via a personal link.

6.2. Flitsmoment has the right to use the photos for commercial purposes.

6.3. Personal data is deleted immediately after the photos are sent and will under no circumstances be shared with third parties.

6.4. Flitsmoment retains the copyright to the photos and therefore the right to use photos on the website and social media for promotional purposes. If this is not desired, we will of course remove the relevant photos within 24 hours.

6.5. In the case of rentals to businesses, the business agrees that we may use its logo in our references. If this is not desired, we will of course remove it immediately.

7. Warranty and Technical Support

7.1. Flitsmoment guarantees 80% usability, which allows Flitsmoment to resolve any technical malfunctions remotely.

7.2. If the photobooth is unusable for more than 20% of the event due to technical issues, the customer is entitled to a partial refund.

8. Complaints Handling

8.1. Complaints regarding the rented photobooth and Flitsmoment's services can be submitted via the email address of the relevant service provider with which the agreement was made.

8.2. Complaints will be handled within 5 working days, with Flitsmoment committed to finding a suitable solution.

9. Applicability of Terms and Conditions

9.1. These extensive terms and conditions apply to all quotes, offers, work and agreements of Flitsmoment, unless explicitly agreed otherwise in writing.
